Terms and Conditions (T&C)
1. Scope of Application
These Terms and Conditions apply to all agreements for the rental of our holiday apartments between the landlord and the guest. **Note:** In case of any discrepancies, the German version of these Terms and Conditions shall prevail.
2. Arrival and Departure
Check-in is possible from 4:00 p.m. on the day of arrival.
Check-out must take place by 11:00 a.m.on the day of departure. Any deviations require prior express agreement. If the guest fails to vacate the apartment on time, the landlord is entitled to claim compensation for use in accordance with Section 546a of the German Civil Code (BGB). This compensation amounts to the agreed daily rental price per commenced day. Further claims for damages, in particular due to subsequent bookings or additional costs, remain unaffected.
3. Cancellation and Withdrawal
The guest may withdraw from the rental agreement at any time prior to the start of the stay. The decisive factor is the receipt of the cancellation notice by the landlord. The following cancellation conditions apply: Free cancellation up to 14 days prior to arrival. In the event of cancellation 14 days or less prior to arrival, or in the case of no-show, the full rental price shall be payable, provided that the apartment cannot be re-let. The landlord is obliged to credit any alternative rental income as well as any expenses saved.
4. Notification of Defects
Any defects, damages, or malfunctions occurring during the stay must be reported to the landlord immediately, so that remedial action can be taken. Failure to report defects in due time may result in a reduction or exclusion of warranty claims.
5. Smoking Policy
All apartments are non-smoking apartments. Smoking is strictly prohibited in all indoor areas. Smoking is permitted only in outdoor areas (e.g. balcony, terrace, or designated outdoor spaces), provided that other guests are not disturbed. In the event of a violation of the smoking ban, the landlord is entitled to charge a special cleaning fee of EUR 250.00. This fee covers the additional costs of the necessary special cleaning. Further claims for damages remain unaffected.
6. Liability
The landlord shall be liable without limitation for damages resulting from injury to life, body, or health caused by a negligent or intentional breach of duty. For all other damages, the landlord shall be liable only in cases of intent or gross negligence. In the event of slight negligence, liability shall be limited to foreseeable, contract-typical damages, provided that essential contractual obligations are affected. No liability is assumed for items brought in by the guest.
7. Obligations of the Guest
The guest undertakes to treat the apartment and its furnishings with care. Any damage occurring during the rental period must be reported to the landlord immediately. The guest shall be liable for all damages caused culpably by themselves, fellow travelers, or visitors.
8. House Rules
The house rules provided to the guest or displayed in the apartment form an integral part of this agreement and must be observed. In the event of serious or repeated violations constituting a material breach, the landlord is entitled to terminate the rental agreement without notice.
9. Pets
Pets are permitted only with prior express agreement.
10. Applicable
Law and Jurisdiction German law shall apply. The place of jurisdiction shall be the landlord’s place of business, insofar as legally permissible.
11. Severability Clause
Should individual provisions of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
